Our Client was asleep in the parking lot of a bar. The car was running, and he was asleep in the driver’s seat. We argued to the prosecutor that our client was using the car as a stationary shelter and not as a motor vehicle and that he posed no danger to the public. Our client was charged with class 4 felony aggravated DUI.
The penalties for an aggravated DUI can be extremely harsh.
After aggressively fighting the DUI charges, a few weeks prior to the trial, the prosecutor agreed to dismiss all of the charges.
