The allegations were that my client was urinating in an alley. An Officer came up to him. Client ran away from the officer. The officer told him to stop. Client kept running and was tackled by another officer.
This was all video recorded on police body camera. The original plea offer was to plead guilty to resisting arrest and dismiss the other charges. We filed a deviation letter to the prosecutor explaining how this was not resisting arrest. A deviation letter is letter that demonstrates to the prosecutor why they should change their offer based on both mitigating evidence and legal reasons.
The prosecutor came back with a diversion offer. A diversion is where client does alcohol classes and does not get in trouble for one year and then the case will be dismissed. Client entered into the diversion plea and completed everything and the case was dismissed.
